Participation in the Promotion constitutes the entrant’s full and unconditional agreement to and acceptance of these Official Rules.
Your participation in the Tournament is also governed by the Wildlife Studios Terms of Service found at https://wildlifestudios.com/terms-of-service (“Wildlife Terms”) and the Wildlife Studios Privacy Policy found at https://wildlifestudios.com/privacy-policy/ (“Wildlife Privacy Policy”).
IMPORTANT NOTICE REGARDING ARBITRATION FOR USERS IN THE US ONLY: WHEN YOU AGREE TO THESE OFFICIAL RULES YOU ARE AGREEING (WITH LIMITED EXCEPTION) TO RESOLVE ANY DISPUTE BETWEEN YOU AND WILDLIFE STUDIOS THROUGH BINDING, INDIVIDUAL ARBITRATION RATHER THAN IN COURT. PLEASE REVIEW CAREFULLY SECTIONS 9 AND 10 (REGARDING DISPUTE RESOLUTION AND GOVERNING LAW) BELOW FOR DETAILS REGARDING ARBITRATION. THESE OFFICIAL RULES ALSO INCLUDE A WAIVER OF RIGHTS BY YOU TO BRING A CLASS ACTION AGAINST WILDLIFE STUDIOS AND A LIMITATION ON DAMAGES THAT YOU CAN COLLECT FROM WILDLIFE STUDIOS THAT MAY ARISE OUT OF YOUR PARTICIPATION IN THE TOURNAMENT.
THE SECTION 8(c) OF THIS DOCUMENT CONTAINS A MANDATORY ARBITRATION PROVISION THAT LIMITS YOUR AND WILDLIFE STUDIOS’ ABILITY TO LITIGATE CLAIMS; AS WELL AS A LIMITATION OF LIABILITY IN SECTION 10 WHICH LIMITS THE LIABILITY OF WILDLIFE STUDIOS TO YOU FOR ALL HARM, DAMAGES, INJURY OR LOSS.
2. PLAYER ELIGIBILITY REQUIREMENTS
A) Eligible Players
The Tournaments are only open to: (i) Game players that are enrolled up until the end of the Qualifying Phase of each Tournament (as described in Appendix I); (ii) Game players that have reached the age of 18 years old.
B) Ineligible Players
Employees of Wildlife Studios, advertising, promotion, fulfillment or other coordinating agencies, individuals providing services to Wildlife Studios through an outsourcer or temporary employment agency during the Tournament, and their respective immediate family and members and persons living in their same household members of each are not eligible to participate in the Tournament, win any prizes, or to have any share or interest of any prize.
Game players that are legal residents of Russia, China, and United Arab Emirates are not eligible for receiving the Grand Final tickets of the tournament.
3. PLAYER CONDUCT AND TECHNICAL RESPONSIBILITY
Wildlife Studios reserves the right to monitor compliance with these rules and impose sanctions for violations, in order to preserve the integrity and fair competition within the Tournament. This section includes, but it is not limited to, the situations described below, in which penalties will be imposed.
A) Standards of Conduct
Players should hold the highest standard of integrity and sportsmanship, by strictly following the rules described herein, as well as competing to the best of their ability at all times independently from their respective Tournament round, adversaries’ level of skill or ownership of items.
B) Standards of Technical Maintenance
Wildlife Studios is not responsible for hardware or software failures presented during the Tournament. As this is a “Bring-Your-Own-Device” (BYOD) Tournament, players are the sole responsible for guaranteeing the appropriate level of maintenance and compatibility specifications of hardware and software, as well as the adequate internet connectivity necessary to play and perform competitively.
i. Match Game and Disconnects
Match disconnects are situations in which the player is unable to start or continue a match due to disconnection. If a player disconnects from the lobby or the match, whether the last had started or was about to start, the penalty is a game loss. Additionally, if a player disconnects, closes the game, or is unable to continue playing for any reason, it will be considered a disconnection and result in a game loss.
The only exception to this rule is the case of massive connection issues between players and the Tournament, in which case Wildlife Studios reserves the right to postpone the Tournament phase or the whole event until the connection problem is resolved.
C) Enforcement
Any player may be disqualified immediately from the Tournament, at the discretion of Wildlife or its agents, for any reason, including for any failure to comply with these Official Rules, the Wildlife Terms, and the Wildlife Privacy Policy.
Without limitation and for the avoidance of doubt, the following shall constitute a violation of the Official Rules and may lead to, in Wildlife’s sole discretion, disqualification from the Tournament: (i) using any cheats, hacks or other third party “helper” applications in playing the Game; (ii) intentionally disconnecting from the Internet during any match; (iii) colluding with other teams in playing matches; (iv) taking advantage of known exploits in the Game (it is the responsibility of players to understand and avoid all such exploits); (iv) abusive or disorderly conduct; and (v) failure to use best efforts during the Tournament including “win trading” or similar conduct that undermines, or has the potential to undermine, the integrity of the Game or the Tournament.
Wildlife Studios reserves the right, in its sole discretion, to disqualify any player at any time, for any reason, including but not limited to tampering with the entry process or the operation of the Tournament, or acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner and reserves the right to void all associated entries. Any attempt by any person to deliberately undermine the legitimate operation of the Tournament may be a violation of criminal and civil law, and should such an attempt be made, Wildlife Studios reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law.
Any failure of Wildlife Studios to enforce any term of these Official Rules shall not constitute a waiver of that provision.
4. GENERAL TERMS AND CONDITIONS
These Official Rules apply to the Tournament Gameplay. In addition to these Official Rules, participation in the Tournament is governed by the Wildlife Terms and Wildlife Privacy Policy.
5. WILDLIFE STUDIOS’ AND FFT’S (FÉDÉRATION FRANÇAISE DE TENNIS) COPYRIGHTS AND TRADEMARKS
All trademarks referenced herein are the properties of their respective owners. The Official Rules and all accompanying materials are copyright Wildlife Studios, and its respective licensors. All rights are reserved. Nothing in these Official Rules, or your participation in the Tournaments, grants to you, by implication, waiver, estoppel or otherwise, any right or license to use or display any name, logo, service mark or trademark of Wildlife Studios or FFT (Fédération Française de Tennis), or their respective licensors.
Anything containing a trademark, copyrighted material or some other element of intellectual property that’s used without the owner’s consent or might subject the Tournament organizer and his affiliates to claims of infringement, misappropriation, or other forms of unfair competition.
6. PERSONAL INFORMATION AND IMAGE
Wildlife Studios may collect, store and use information collected in connection with the Tournament, in accordance with the Wildlife Privacy Policy. By participating in the Tournament, you hereby agree to such collection and use of your personal information by Wildlife Studios, and acknowledge that you have read and accepted these Official Rules, the Wildlife Terms, and Privacy Policy.
You acknowledge that Wildlife Studios may ask for additional information, such as your local address, full name and personal contact details, in order to distribute prizes. You acknowledge that Wildlife Studios may use and share that information with third parties to distribute prizes for winners.
By agreeing to these Official Rules and participating in the Tournament, you hereby grant to Wildlife Studios and its subsidiaries and affiliates a perpetual, royalty-free, fully paid-up, worldwide, right and license (with the right to grant sublicenses) to copy, display, distribute, edit, host, store and otherwise use your image, likeness, voice, in-game nickname, name, gameplay and/or photograph, and create derivative works thereof, in any and all present and future media whether now known or hereafter created, on any and all platforms and via any method of delivery, on or in connection with the Tournament and with the marketing and promotion of the Tournament in general.
7. LIABILITY (CAP ON LIABILITY; NO PUNITIVE DAMAGES) AND RESOLUTION OF DISPUTES
A) Applicability
This Section 8 applies to and governs any dispute, controversy, or claim, whether based on contract, tort, fraudulent misrepresentation, statute, regulation, constitution, common law, equity, or any other matter, that arises out of or relates to the Tournament, a prize or these Official Rules, or the breach thereof (each, a “Dispute”).
B) Negotiations
- In an effort to accelerate resolution and reduce the cost of any Dispute, you and Wildlife Studios agree to first attempt to negotiate a resolution of any Dispute informally for at least thirty (30) days before either party initiates any arbitration or court proceeding, unless one or more of the exceptions to negotiations and arbitration in Section 8(e) below apply.
- Negotiations will begin upon receipt of written notice by the party raising the Dispute. Wildlife Studios will send its notice to any billing address it has on file and email you a copy to any email address you have provided to Wildlife Studios.
- You will send your notice to Wildlife Studios at Rua Doutor Renato Paes de Barros, 1017, 8º floor, CEP 04530-001, São Paulo, São Paulo, Brazil
C) Binding Arbitration
- If a Dispute cannot be resolved through negotiations, either you or Wildlife Studios may elect to have the Dispute finally and exclusively resolved by binding arbitration, unless one or more of the exceptions to negotiations and arbitration in Section 8(e) below apply. Any election to arbitrate by one party shall be final and binding on the other.
- YOU SHOULD REVIEW THIS PROVISION CAREFULLY. THIS ARBITRATION PROVISION LIMITS YOUR AND WILDLIFE STUDIOS’ ABILITY TO LITIGATE CLAIMS IN COURT AND YOU AND WILDLIFE STUDIOS EACH AGREE TO WAIVE YOUR RESPECTIVE RIGHTS TO A JURY TRIAL.
- The arbitration shall be commenced and conducted by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures, which are available at the JAMS website (http://www.jamsadr.com). If, for any reason, JAMS is unable to provide the arbitration, you may file your Dispute with any national arbitration company under the Commercial Arbitration Rules of the American Arbitration Association. The arbitrator has authority to decide all issues of arbitrability, including where a party raises as a defense to arbitration that the claims in question are subject to one or more exceptions to negotiations and arbitration in Section 8(e) below.
- Where any action includes claims that are arbitrable and claims that are not, the entire action shall be stayed, absent a showing of prejudice to the complaining party, pending the completion of the arbitration of the arbitrable issues. You or Wildlife Studios can request the stay be lifted upon a showing of prejudice. Your arbitration fees and your share of arbitrator compensation shall be governed by the JAMS Comprehensive Arbitration Rules and Procedures.
D) Arbitration Procedures
The arbitration may be conducted in person, through the submission of documents, by phone, or online. The arbitrator will make a decision in writing, but need not provide a statement of reasons unless requested by a party. The decision of the arbitrator shall be final and binding on you and Wildlife Studios, and any award of the arbitrator may be entered in any court of competent jurisdiction.
THE PARTIES UNDERSTAND THAT, ABSENT THIS MANDATORY PROVISION, THEY WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. They further understand that, in some instances, the costs of arbitration could exceed the costs of litigation. The parties understand that the right to discovery may be more limited in arbitration than in court.
E) Exceptions
You and Wildlife Studios agree that the following Disputes are not subject to the above provisions concerning negotiations and binding arbitration: (i) any Dispute seeking to enforce or protect, or concerning the validity of, any of Wildlife Studios’ intellectual property rights; (ii) any Dispute related to, or arising from, claims that the other party has committed piracy or tortious interference; and (iii) any claim within the jurisdictional limits of the small claims courts.
F) Class and Collective Action Waiver
- You and Wildlife Studios agree that any arbitration or court proceeding shall be limited to the Dispute between Wildlife Studios and you individually. You acknowledge and agree that: (i) a claim by, or on behalf of, other persons, will not be considered in, joined with, or consolidated with, the arbitration proceedings or any court proceedings between you and Wildlife Studios; (ii) there is no right or authority for any Dispute to be arbitrated, adjudicated, or resolved through court proceedings on a class-action basis or to utilize class action procedures; and (iii) you will not have the right to participate as a class representative, private attorney general, or as a member of any class of claimants for any Dispute subject to arbitration or any dispute brought in court. Any Dispute regarding the prohibitions in the prior Sections shall be resolved by the arbitrator in accordance with this Section 8.
- If, for any reason, this class or collective action waiver is deemed unenforceable by a court or arbitrator, you agree that the parties’ contract to arbitrate is then void, and any ongoing or future Dispute will be submitted to a court of competent jurisdiction within the State of California, United States, to the exclusion of arbitration. Any Dispute at that time in arbitration will be dismissed without prejudice and refiled in a court.
- Under no circumstances do you or Wildlife Studios agree to class or collective procedures in arbitration or court proceedings or the joinder of claims in arbitration or court proceedings.
G) Location of Arbitration
- If you are a resident of the United States, any arbitration will take place in your county of residence, to the exclusion of all other venues.
- For residents outside the United States, any arbitration shall be initiated in State of California, United States.
- Any Dispute not subject to arbitration shall be decided by solely a court of competent jurisdiction within the State of California, United States, and you and Wildlife Studios agree to submit to the personal jurisdiction of that court.
- You and Wildlife Studios agree that the following Disputes are not subject to the above provisions concerning negotiations and binding arbitration: (i) any Dispute seeking to enforce or protect, or concerning the validity of, any of Wildlife Studios’ intellectual property rights; (ii) any Dispute related to, or arising from, claims that the other party has committed piracy or tortious interference; and (iii) any claim within the jurisdictional limits of the small claims courts.
8. GOVERNING LAW
- All Disputes shall be governed by and construed under the laws of the State of California, United States, without regard to choice of law principles, provided that Wildlife Studios shall have the right to disqualify any players that are rendered ineligible due to local law.
- Players agree to be bound by these Official Rules and by the decisions of Wildlife Studios with respect to the disciplinary actions imposed for their violation, which are final and binding in all respects. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
9. LIMITATION OF LIABILITIES AND DISCLAIMERS

You understand and agree that Wildlife Studios are not insurers of your property or your personal safety. If you feel that you need insurance, you should obtain it from an insurance company or other third party.
- YOU AGREE THAT THE LIABILITY OF WILDLIFE STUDIOS TO YOU FOR ALL HARM, DAMAGES, INJURY OR LOSS SHALL BE LIMITED TO YOUR DIRECT DAMAGES NOT TO EXCEED FIVE HUNDRED US DOLLARS (US $500.00), AND THIS SHALL BE YOUR ONLY REMEDY REGARDLESS OF WHAT LEGAL THEORY IS USED TO DETERMINE THAT WILDLIFE STUDIOS WAS LIABLE FOR THE HARM, DAMAGES, INJURY OR LOSS. MULTIPLE CLAIMS WILL NOT EXPAND THIS LIMITATION.
- YOU FURTHER AGREE THAT THE LIMITATION OF LIABILITY IN THIS SECTION SHALL APPLY EVEN IF IT IS DETERMINED THAT WILDLIFE STUDIOS CAUSED THE HARM, DAMAGES, INJURY OR LOSS TO YOU. THE FOREGOING LIMITATIONS APPLY EVEN IF YOUR REMEDIES UNDER THESE OFFICIAL RULES FAIL OF THEIR ESSENTIAL PURPOSE.
- IN NO EVENT SHALL WILDLIFE STUDIOS BE LIABLE UNDER TO YOU, OR ANY PERSON OR ENTITY CLAIMING RIGHTS DERIVED FROM YOU, FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, EXEMPLARY, SPECIAL OR PUNITIVE DAMAGES, INCLUDING ANY DAMAGES FOR LOSS OF DATA, REVENUE, PRIZES OR PROFIT, WHETHER ARISING OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE AND WHETHER OR NOT WILDLIFE STUDIOS WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
